Terms and Conditions

Welcome to Smart Agricultural Research Industries (S.A.R.I.). These Terms and Conditions (“Terms”) govern your use of our website (www.sariagritech.com) and the purchase of our products, including the Electro Mist and Turbo Mist 600.

By accessing this website or purchasing our machinery, you agree to be bound by these Terms.

1. General Conditions

1.1 Eligibility: You must be at least 18 years of age and a resident of India to enter into a binding contract with S.A.R.I.

1.2 Product Specifications: Illustrations and descriptions in our brochures or website are for representational purposes. S.A.R.I. reserves the right to alter technical specifications to improve product performance without prior notice.

2. Intellectual Property (Deep Tech Protection)

2.1 Ownership: All technology, including the 1500V Electrostatic Charging System, nozzle designs, software, and branding, is the exclusive Intellectual Property of S.A.R.I.

2.2 Restrictions: Buyers are strictly prohibited from reverse-engineering, replicating, or modifying the electrostatic components or proprietary mechanics of S.A.R.I. products. Any such attempt will result in immediate termination of warranty and legal action under the Patents Act, 1970.

3. Sales and Payment

3.1 Pricing: All prices quoted are Ex-works (Pune) unless otherwise stated. Statutory taxes (GST), transportation, insurance, and octroi are payable extra by the purchaser.

3.2 Order Cancellation: In case of cancellation by the buyer after order confirmation, S.A.R.I. reserves the right to deduct a minimum of 5% of the gross price as administrative and procurement charges from the advance amount.

3.3 Retention of Title: S.A.R.I. remains the legal owner of all machinery until full payment is received.

4. Warranty Policy

4.1 Standard Term: S.A.R.I. provides a 2-year limited warranty on major structural and mechanical components (Chassis, Tank, Pump, and Gearbox).

4.2 Exclusions: This warranty does NOT cover:

  • Damage caused by using contaminated water or non-recommended chemicals.
  • Repairs conducted by unauthorized technicians.
  • Failure resulting from a lack of routine maintenance as prescribed in the User Manual.

5. Limitation of Liability and Safety

5.1 Operator Responsibility: S.A.R.I. machinery involves high-pressure liquid systems and electrostatic charges. It is the buyer's sole responsibility to ensure that only trained operators handle the equipment.

5.2 Usage Risks: S.A.R.I. shall not be liable for any bodily injury, property damage, or crop loss resulting from:

  • Improper calibration of the sprayer.
  • Failure to wear Personal Protective Equipment (PPE).
  • Operation in weather conditions not suitable for spraying (e.g., high winds).

5.3 Strict Liability: Under the Consumer Protection Act, 2019, S.A.R.I. is not liable for harm caused by "misuse" or "alteration" of the product by the consumer.

6. Force Majeure

S.A.R.I. shall not be held responsible for delays in delivery caused by acts of God, strikes, transport disruptions, power failures, or government restrictions (including changes in subsidy or financing norms).

7. Dispute Resolution

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, and shall be governed by the laws of India.
